Statement from Manchester Township Board regarding Ashkay Island, LLC
The following statement was submitted to The Mirror by the Manchester Township Board on October 27, 2020:
October 26, 2020
Over the past several years, the reoccurring issue of AshKay Island, LLC, which operates a commercial private island vacation resort located on Iron Mill Pond in Manchester Township, has come before the Township Board. It is unfortunate that what started out as a neighbor dispute has escalated through neighbor complaints; and a private lawsuit started by neighbors against AshKay Island, LLC has now become a matter in which the Township Board has been forced to consider its own litigation against AshKay Island.
It is important to note that to date no Township lawsuit has been filed against AshKay Island, LLC.
On September 29, 2020 the Township attorney did present a motion to file an Amicus Curiea brief with the Court of Appeals. An Amicus Curiea brief is simply a request to present the Township’s information on its zoning ordinances as they pertain to operation of a commercial business in a rural agricultural district. The purpose is to provide the court with additional information to consider during the appeal process in the case between the neighbors and AshKay Island, LLC. On October 20, 2020 the Court of Appeals agreed to accept the brief.
The Manchester Township Board is elected by township residents and each member takes an oath to faithfully perform the duties of the office. Board members would be derelict in their duties if they did not accept citizen complaints and try to resolve them using ordinances which have been researched, developed and voted on throughout the years. When ordinances no longer exactly address current issues, citizens, the Planning Commission, and the Township Board must work together to propose and adopt changes. This the process that has been started with addressing short term rentals in Manchester Township.
The Manchester Township Board welcomes and encourages questions or concerns about issues in the township to be brought to it, either through a personal visit, phone call or written communication to the township office. The office is located at 275 S. Macomb Street; our phone number is 734-428-7090. Township office hours are Monday, Tuesday, Wednesday and Friday from 8:30 until 12:00 noon. The Township website is www.twp-manchester.org and a complete list of board members as well as their email addresses can be found by clicking on “Menu” then “Township Board” then “Board Members.” While some members of the Board may monitor various social media platforms, the Board will not be engaging the public via social media.
