NOTICE OF ADOPTION
ORDINANCE No. 316
AN ORDINANCE TO AMEND THE VILLAGE ZONING ORDINANCE TO ALLOW FOR A MARIJUANA OVERLAY DISTRICT.
THE VILLAGE OF MANCHESTER, WASHTENAW COUNTY, MICHIGAN, HEREBY ORDAINS:
Section 1. Amendment To Zoning Ordinance for the Village of Manchester:
Ordinance No. 316, the Marijuana Overlay District, as incorporated in Chapter 151 of the Village of Manchester Code of Ordinances, Section 151.055 is hereby amended added to read as follows:
Sec. 151.055. Marihuana facilities overlay district (MFOD).
(A) The State of Michigan has adopted legislation to permit different types of marihuana facilities. The marihuana facilities overlay district (MFOD) is established as a special district to permit the establishment of such facilities in the village.
(B) Intent. The MFOD overlay district is intended to overlay certain designated and/or named properties in the I-2 industrial zoning district.
(C) Permitted medical marijuana uses. The following types of medical marijuana facilities, as authorized by the Medical Marihuana Facilities Licensing Act, MCL 333.27101 et seq. and the Village of Manchester Regulation of Marihuana Facilities Ordinance, are permitted uses in the MFOD district:
(i) Marihuana safety compliance center.
(ii) Marihuana provisioning centers.
(E) Permitted recreational uses. The following types of recreational marijuana facilities, as authorized by the Michigan Regulation and Taxation of Marihuana Act (Initiated Law 1 of 2018) and the Village of Manchester Regulation of Marihuana Facilities Ordinance, are permitted uses in the MFOD district:
(i) Marihuana safety compliance center.
(ii) Marihuana retailers.
Section 2. Severability
If any section, paragraph, clause, or provision of this Ordinance shall be held invalid, the invalidity of such section, paragraph, clause, or provision shall not affect any of the other provisions of this Ordinance.
Section 3. Effective Date
The Village Clerk shall cause this Ordinance, or a synopsis of this Ordinance, to be published in the manner required by law within fifteen (15) days after it has been duly adopted by the Village Council. The effective date shall be the 20th day after the date of publication.
