ORDINANCE No. 8

AN ORDINANCE TO AMEND THE CITY OF MANCHESTER’S PENALTY FOR VIOLATION OF BUILDING REGULATIONS.

THE CITY OF MANCHESTER, WASHTENAW COUNTY, MICHIGAN, HEREBY ORDAINS:

Section 1.  Amendment to 153.99 of the Manchester Code of Ordinances

A violation of this chapter shall be a municipal civil infraction subject to prosecution and penalty under the City Municipal Civil Infractions Ordinance. The requirements of this chapter are in addition to, and not in lieu of, any other rights and remedies provided by law. Violation of this chapter shall be a municipal civil infraction and for the first offense subject to a minimum $200 fine and any of the penalties authorized under M.C.L.A. §600.8727 and/or M.C.L.A. § 600.8302. Second or subsequent offenses shall be subject to a minimum fine of $400 and any of the penalties authorized under M.C.L.A. §600.8727 and/or M.C.L.A. § 600.8302. Each day that a violation continues shall be considered a separate offense.

Further, any violation of the violation of the State Construction Codes is hereby declared to be a nuisance per se. Upon application to any court of competent jurisdiction, the court may order the nuisance abated and/or the violation, or threatened violation, restrained and enjoined.

Section 2. Repeal of Conflicting Provisions

All other City ordinances, City Council resolutions, and parts thereof that conflict with the provisions of this Ordinance are hereby repealed and shall be of no further force or effect.

Section 3. Severability
If any section, paragraph, clause, or provision of this Ordinance shall be held invalid, the invalidity of such section, paragraph, clause, or provision shall not affect any of the other provisions of this Ordinance.

Section 4. Effective Date
The City Clerk shall cause this Ordinance, or a synopsis of this Ordinance, to be published in the manner required by law within fifteen (15) days after it has been duly adopted by the City Council. The effective date shall be the 20^th day after the date of publication.
