NOTICE OF ADOPTION

ORDINANCE No. 300

PORTABLE STORAGE CONTAINERS

AN ORDINANCE TO AMEND THE VILLAGE ZONING ORDINANCE, ORDINANCE NO. 239 OF 2001, AS IT IS INCORPORATED IN THE VILLAGE OF MANCHESTER CODE OF ORDINANCES, TITLE XV: LAND USAGE, CHAPTER 151: ZONING CODE, SECTION 151.007: DEFINITIONS ADDING TEMPORARY PORTABLE STORAGE CONTAINERS AND SECTION 151.090: TEMPORARY PORTABLE STORAGE CONTAINERS. 

THE VILLAGE OF MANCHESTER, WASHTENAW COUNTY, MICHIGAN, HEREBY ORDAINS:

Section 1. Amendment To Definitions

Ordinance No. 239, the Zoning Ordinance, as incorporated in Chapter 151 of the Village of Manchester Code of Ordinances, Section: 151.007 Definitions is hereby amended adding: Temporary Portable Storage Container. A non-habitable, transportable, weather-resistant receptacle designed and used for the storage or shipment of household goods, wares, building materials or merchandise on a temporary basis. 

Section 2. Amendment to Special Provisions

Ordinance No. 239, the Zoning Ordinance, as incorporated in Chapter 151 of the Village of Manchester Code of Ordinances is hereby amended adding:

Section 151.090 Temporary Portable Storage Containers

Temporary portable storage containers may be permitted in all zoning districts subject to the following regulations:

(a) A portable storage container shall be permitted subject to the validation of an active building permit.

(b) In agricultural and residential zoning districts, no more than one (1) temporary portable storage container may be permitted on a property at one time. In commercial and industrial zoning districts, no more than two (2) temporary portable storage containers may be permitted on a property at one time.

(c) A portable storage container shall not be utilized for or contain habitable space. 

(d) Temporary portable storage containers may not be located in an area that would interfere with vehicular or pedestrian circulation or cause reduced visibility at street intersections. 

(e) A temporary portable storage container may be utilized as a  detached accessory structure incidental to a principal structure, subject to the following additional standards: (1) A temporary portable storage container shall be located within the rear yard and shall be set back at least ten (10) feet from side and rear property lines and at least ten (10) feet from the principal structure. (2) An individual temporary portable storage container shall not exceed two-hundred (200) square feet in area and eight and a half (8.5) feet in height. (3) The exterior appearance of all temporary portable storage containers shall be maintained and absent or all rust, holes, and any other evidence of aging or wear. (4) A temporary portable storage container may be placed on a paved or gravel off-street surface in the front yard. In all cases, temporary portable storage containers shall be set back at least twenty (20) feet from the front property line and ten (10) feet from the side or rear property line. (5) The use of not more than one (1) temporary portable storage container is permitted for not more than sixty (60) continuous or separate days. One (1) time extension shall be permitted beyond the initial sixty (60) days contingent on Village Council approval. (6) A temporary portable storage container may be placed on a property with an active building permit and must be removed no later than twelve (12) days after the issuance of a certificate of occupancy or the completion of construction. 

The Zoning Administrator may authorize time to utilize temporary portable storage containers based upon reasonable storage needs and construction needs upon the written request of the applicant, but in no case, shall the Zoning Administrator allow such storage containers on properties without active building permits for greater than four (4) months. 

Section 3. Severability 

If any section, paragraph, clause, or provision of this Ordinance shall be held invalid, the invalidity of such section, paragraph, clause, or provision shall not affect any of the other provisions of this Ordinance.

Section 4. Effective Date

The Village Clerk shall cause this Ordinance, or a synopsis of this Ordinance, to be published in the manner required by law within fifteen (15) days after it has been duly adopted by the Village Council. The effective date shall be the 20th day after the date of publication.
